UW­–Madison alumni Bruce Meredith and Mark Paige have published an article in the Houston Law Review that is titled, “Reversing Rodriguez: A Siren Call to a Dangerous Shoal.”

Paige is a School of Education graduate, having earned his PhD from the School’s Department of Educational Leadership and Policy Analysis in 2011. He is currently an associate professor at the University of Massachusetts–Dartmouth. Meredith earned his J.D. from the University of Wisconsin Law School, and is the former general counsel to the National Education Association Wisconsin Affiliate.

The article argues against continued attempts to reverse the landmark case San Antonio Independent School District v. Rodriguez, 411 U.S. 1 (1973), which declared education is not a fundamental right. Instead, the authors argue that educational law scholars and advocates should tackle obstacles to voting and political power — many, they say, which were created or exacerbated by recent Supreme Court decisions.

“We argue that the remedies being sought by those seeking to reverse or distinguish Rodriguez can be better attained by ensuring a fair political process, which begins with equality at the ballot box, and protecting an individual’s right to vote, the bedrocks of our republican democracy,” the authors write in the article abstract.
